End User License Agreement

This End User License Agreement ("Agreement") is a legal agreement between you ("End-User", "you") and Stride Technologies Limited ("we", "us", "our", "Licensor") governing your use of any mobile or software application published by Stride Technologies Limited, including DressageScore and any other application we make available from time to time (each, a "Licensed Application"). By downloading, installing, or using a Licensed Application, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or use the Licensed Application.

1. License grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions — including access via Family Sharing or volume purchasing where applicable. This license is for your personal, non-commercial use only, unless we've agreed otherwise with you in writing.

2. Restrictions

You may not, and may not permit anyone else to: copy, modify, or create derivative works of the Licensed Application; reverse-engineer, decompile, or disassemble it, except where applicable law expressly permits it; rent, lease, lend, sell, redistribute, or sublicense it; or remove, alter, or obscure any proprietary notices. You agree not to use the Licensed Application for any unlawful purpose.

3. Acknowledgement

This Agreement is concluded between you and Stride Technologies Limited only, and not with Apple. Stride Technologies Limited, not Apple, is solely responsible for the Licensed Application and its content.

4. Maintenance and support

Stride Technologies Limited is solely responsible for providing any maintenance and support services for the Licensed Application, to the extent such services are described in this Agreement or required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services for the Licensed Application.

5. Warranty

Stride Technologies Limited is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you, where applicable. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Stride Technologies Limited's sole responsibility.

6. Product claims

Stride Technologies Limited, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

7. Intellectual property

The Licensed Application, and all intellectual property rights in it, remain the property of Stride Technologies Limited or its licensors. This Agreement does not grant you any rights to our trademarks or trade names. In the event of any third-party claim that the Licensed Application, or your possession and use of it, infringes that third party's intellectual property rights, Stride Technologies Limited, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

8. Legal compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms

You must comply with any applicable third-party terms of agreement when using the Licensed Application — for example, if the Licensed Application uses data connectivity, your wireless data service agreement.

10. Termination

This Agreement is effective until terminated. It will terminate automatically if you fail to comply with any of its terms. Upon termination, you must stop all use of the Licensed Application and, where applicable, delete it from your devices.

11. Apple as third-party beneficiary

You and Stride Technologies Limited acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it.

12. Governing law

This Agreement is governed by the laws of Ireland, without regard to its conflict of law provisions.

13. Changes to this Agreement

We may update this Agreement from time to time. The "last updated" date at the top of this page reflects the most recent revision. Continued use of a Licensed Application after changes take effect constitutes acceptance of the revised Agreement.
